Montreal, April 11th, 2018. The Honourable Chantal Tremblay, Superior Court of Quebec, rendered a judgement that authorizes the class action suit by Les Pollués de Montréal-Trudeau (LPDMT), against Aéroports de Montréal-Trudeau, NAV Canada, and the federal Transport Canada. The suit seeks a decrease in the noise created by airplanes overflying Montreal and reasonable compensation for the population affected by it.
On behalf of the citizens group LPDMT, the president Pierre Lachapelle noted:
We are pleased to have obtained this authorization. Of particular interest is the judge’s comment in paragraph 62: “The allegations of the request for authorization and the supporting documentation are sufficient to justify a case against Montreal-Trudeau Airport, based on article 1457 of C. c. Q.” This is good news for the rights of citizens who are subjected to excessive noise, day and night.
The lawyer for the citizens group, Gérard Samet, underlined the seven questions that the Honourable Chantal Tremblay identified for the next step in the process. Two of these are of particular interest:
“Are faults occuring with the management of the soundscape as well as the procedures for approaching and taking off from Montreal-Trudeau Airport?
Should the norms that apply to airplane noise be public, and if so, who is to make them public? If they are not public, is it a fault to not make them public?
Who is potentially concerned by the suit? The suit mainly concerns residants of: Ahuntsic-Cartierville, Mont-Royal, Saint-Laurent and Villeray-Saint-Michel-Parc-Extension. The area is based in part on data obtained by noise monitoring stations installed by LPDMT. To whom it may concern;…i have read the request by Arkady to join the suit and i find your answer to be much too vague to make me accept it,sorry.I live in villeray on lajeunesse street,i have planes almost in my living room after midnight on some occasions,so i understand mr Arkady…Subscribing to your news letter and your progress does not mean i am included or will benibenifit by any of your efforts….how are you planning to compensate ???             I do live in the L’Acadie/Sauve neighbourhood and we have tremendous overhead noise pollution from all the planes that are about to land at Trudeau airport.
            I thought there was a curfew (no incoming flights after midnight) but I guess I was wrong because I hear planes landing as late as 2:00-2:30 am. I will be following the outcome of your current collective lawsuit .

            There is unfortunately no curfew at the airport. There used to be one many years ago but since the flight transfers from Mirabel to Dorval starting in 1996, there is none.
